The guidance encourages California homeowners who are struggling with their mortgage or other property-related obligations to evaluate their options early, while there is still time to make a deliberate decision.

The advisory emphasizes that financial trouble does not automatically mean foreclosure. It also does not automatically mean that selling the home is necessary. The first step should be determining whether keeping the property is financially sustainable and what alternatives remain available if it is not.

Claims of nonprofit status, legal assistance, principal reduction or foreclosure prevention should not substitute for an individualized analysis of whether the proposed strategy is realistic.

Lawyers Realty Group recommends that homeowners ask who is actually responsible for reviewing their matter and whether they can speak directly with the attorney providing the legal analysis.

“If someone is telling you they can save your home, you should be able to speak directly with the attorney responsible for that advice and understand exactly what is being proposed,” Lewis said. “Your home may be your largest financial asset. You should know who is advising you and what the backup plan is if their strategy fails.”
